Is My TPS Work Permit Still Valid? A Country-by-Country Guide (August 2026)

The fastest-moving immigration question right now is simple: is my TPS work permit — my EAD — still valid today? Here's what USCIS has officially published, country by country.

What happened and why

On June 25, 2026, the U.S. Supreme Court ruled 6–3 in two consolidated cases — Trump v. Miot (No. 25-1084, Haiti's case) and Mullin v. Doe (No. 25-1083, the parallel Syria case) — that the government's decision to terminate TPS for Haiti and Syria was not subject to judicial review. That ruling unblocked a wave of terminations that district courts had previously paused. After the ruling, USCIS moved country by country — sometimes with only hours of notice — adjusting EAD expiration dates. The pattern: USCIS sets a "placeholder" date, sometimes extends it briefly, then lets it lapse once a lower court dissolves its injunction or issues an implementing order.

Haiti, Syria, and Yemen are now fully terminated — their A12 and C19 EADs are invalid, employers must reverify, and affected workers need a new valid work-authorization document to stay employed.

Burma and South Sudan joined the terminated list on August 7, 2026, when USCIS announced those designations were officially ended.

Somalia and Ethiopia remain protected by federal court orders — district courts have not yet dissolved their injunctions, despite the SCOTUS ruling. USCIS has been issuing short extensions (sometimes a week at a time) while those courts take action. If you are from either country, check the USCIS TPS page for your specific country before assuming your card is valid.

El Salvador, Lebanon, Sudan, and Ukraine have independently extended TPS designations that were not part of the termination wave. Their protections run through the dates listed above.

How to read the category code on your EAD

Turn your work permit over. Under "Category," look for:

  • A12 — granted TPS. This is the category affected by terminations.
  • C19 — pending TPS. Also affected.

If your category code is something else (C08 for pending asylum, for example), your work authorization comes from a different basis and TPS terminations don't directly touch it — though you should still verify your current status.

What if my EAD just expired and I'm from a terminated country?

If your A12 or C19 EAD has expired and your country's TPS has ended, you cannot legally continue working on that document. You have a few potential next steps depending on your situation:

  • If you have a pending asylum application, you may qualify for a different EAD category — talk to an accredited rep about Form I-765 under category C08.
  • If you have a family petition or other pending immigration case, you may have alternative work authorization — verify with a representative.
  • If you have no other open immigration case, you should speak with an accredited representative as soon as possible about what options may exist.
